Kolkata police serves notice to CBI, approaches High Court

While the CBI approached Supreme Court seeking contempt of court proceedings against Kolakata police and West Bengal government, for denying them to interrogate City Police Commissioner, last evening, in a counter  move the Kolkata Police service a notice to CBI Joint Director, stationed in Kolkata Pankaj Kumar Srivastava, in connection with `wrongful restraint’ and `wrongful confinement’ of two businessmen in August, 2018.

Moreover, the West Bengal government approached the High Court against the CBI’s attempt to question city police chief at his residence, in connection with chit fund scam cases. However, the Court refused immediate hearing and posted for tomorrow.

Following objection by the Union government, Justice Shivakant Prasad refused to give the matter an immediate hearing and listed it for Tuesday. State Advocate General Kishore Dutta submitted that despite a stay by the high court on steps regarding notice to state police officials, the CBI sought to enter Kumar’s residence on Sunday and question him.

He submitted that the court is scheduled to hear the matter on February 13 and as such, the CBI’s attempt to enter Kumar’s official residence was in violation of its order.

Additional Solicitor General Kaushik Chanda submitted that the stay was on a CBI notice to only Arnab Ghosh, the then deputy commissioner (detective department) of Bidhannagar Police, which initially investigated the chit fund case, and two other police officials – Dilip Hazra and Sankar Bhattacharya.

The city police notice served to CBI Joint Director read : “Please provide the details, particulars pertaining to present posting and rank of CBI officer Sri Sunil Meena and other officials who were present during detention of Vaibhav Khator of 1, Janendra Avenue, Shree Apartment, Police station Uttarpara, Hooghly, and Vivek Agarwal s/o Mahesh Agarwal of 493, B7, GT Road, Panchsil Apartment, Howrah at CBI (ACB) Office at Nizam Palace on August 17 and August 18, 2018.”

It further read, “Please provide the CCTV footage of CBI (ACB) office at Nizam Palace for the period from August 17 and August 18, 2018. It is pertinent to mention here that earlier in course of preliminary enquiry on several occasions the above-mentioned information/documents were sought for but no reply was received till date.”
